2. Description of Service

BeBetter Sport is a platform that enables users to upload videos of their sports performance and receive feedback from expert coaches. Our Service includes:

  • Expert coach feedback and analysis
  • Social features for sharing and viewing content
  • User profiles and public content sharing
  • Payment processing for premium features and services

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

Important: All videos and feedback uploaded to the Service are publicly accessible. By uploading content, you acknowledge and consent to this public visibility.

4.2 Content Standards

You agree not to upload, post, or share any User Content that:

  • Infringes upon the rights of others, including intellectual property rights
  • Is defamatory, harassing, abusive, threatening, or discriminatory
  • Contains obscene, pornographic, or otherwise offensive material
  • Contains viruses, malware, or other harmful code
  • Impersonates any person or entity or misrepresents your affiliation
  • Contains false or misleading information

4.3 Content Moderation

We reserve the right to review, modify, or remove any User Content that violates these Terms or is otherwise objectionable, in our sole discretion. We are not obligated to monitor User Content but may do so at any time.

5. Payment Terms

5.1 Fees and Billing

Certain features of the Service may require payment. You agree to pay all fees associated with your use of paid features. All fees are stated in the currency specified at the time of purchase and are non-refundable unless otherwise stated.

5.2 Payment Processing

Payments are processed by third-party payment processors. By making a purchase, you agree to the terms and conditions of the applicable payment processor. We are not responsible for any errors or issues with payment processing.

5.3 Refunds

We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed but may apply to future purchases or subscription renewals.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service, including coach feedback and analysis.

The feedback and analysis provided by coaches on the Service are opinions and should not be considered as professional medical, legal, or financial advice. Always consult with qualified professionals for such advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEBETTER SPORT, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless BeBetter Sport and its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BeBetter Sport operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeBetter Sport regarding the Service and supersede all prior agreements and understandings.
